Scope

The following Terms and Conditions (Terms) apply to all orders placed via our online shop.

These Terms also apply to businesses for future commercial relations without the need for any formal expression thereof. Unless expressly approved by us to the contrary, we cannot accept the contractual validity of any conflicting or complementary general terms and conditions used by any business.

Contractual partner, formation of contract, options for corrections

By placing the products in the online shop, we make a binding offer on our part to enter into a contract regarding those items. You may place our products in the shopping basket without obligation and amend your entries at any time prior to submitting your binding order by using the correction facilities that are provided for this purpose and explained during the ordering process. The contract is formed by clicking on the order button which indicates your acceptance of our offer concerning the goods contained in the shopping basket. Once you have sent your order you will immediately receive a confirmation via e-mail.

Contract language, saving of the contract text

The language(s) available for concluding the contract: English

We save the text of the contract and forward the order data and our Terms and Conditions to you on a durable medium. For security reasons, the text of the contract cannot be accessed via the internet.

Delivery conditions

Delivery costs are added to the product prices as displayed. Delivery charges are explained within individual product offers.

Warranty and guarantees

For consumers, statutory warranty rights governed by the law of the country where the consumer has his habitual residence apply. Information on any additional guarantees and their precise conditions that may apply can be found next to the product and on specific information pages in the shop, if applicable. Complaints can be submitted by consumers and businesses to our contact details given in the supplier identification.

When you exercise your warranty rights and we deem it necessary to receive the goods back in order to examine your complaint, you must send back the goods at your cost by DHL to the address given above. We are committed to respond to any complaint immediately, but no later than within 14 days of its submission.

DISCLAIMER

Our controller is not guaranteed to work with every bike or scooter setup. It was tuned specifically on originals which were bought in official representatives shops. All kits are not waterproof! it is resistant to water and likely won’t have an issue getting wet but it’s not possible for us to make it waterproof without sealing the harness in place. Take this into consideration when using the bike or scooter. All kits give out more watts than motors are rated. Do not under any circumstances bypass/remove/tamper with the breaker that comes stock on the bike. Usually stock motors are rated for less watts and running at levels higher than this can potentially lead to cutting out or motor damage and should be done at your own discretion. We are not responsible for the wheel spinning and launching the bike if you start your bike for the first time not on a stand. If your upgrade kit will not work from the begin, you need to schedule for remote tuning via Samsung phone because end users WON’T have BACDoor Access. Email us to set up your tuning session to get your bike / scooter running. One free remote tuning session will be provided to get the bike running if there are issues. After the initial tuning session has resolved the issues, additional tuning sessions needed for aftermarket upgrades or changes to the bike / scooter can be purchased on our website for 150 EUR.

Controllers DOES NOT have safeguards in place to prevent you from damaging your motor or battery. You must understand the limitations of your scooter / bike electronics. If your battery is stock (not bypassed) you don’t need to worry about this. We are not responsible for damage done to the electronics due to misuse. This includes monitoring your battery voltage and amperage as the controller has no safeguard for either.

We do not accept returns if product is damaged by customer. Faulty controllers must be sent back to us and we will exchange it to the new one. If you use your controller and decide you don’t want it, we CAN NOT accept a return. Use of the controller involves anything from mounting it to the bike or attaching pole wires from the motor. If you receive your controller with physical damage to anything in the package, contact us. We can get you new parts and submit a claim with the shipper (this must be well documented).

If you decide you want it re-tuned from 52V to 72V we will charge a tuning fee, you will need to schedule a time and it requires a Samsung phone.

Attempting to extract our proprietary tune is theft of intellectual property and against the law.

Buyer releases Electric Gen or any person trading on or behalf of the business known as Electric Gen from any liabilities, therein known as Electric Gen (expressed or implied, arising by law or otherwise) that may occur from the use of products sold by Electric Gen and purchased by Buyer. These products are being sold for “Off Road/Competition Use” only and may be used only on two wheel vehicles (bicycles, electric bicycles, two wheel electric powered vehicles) used solely for “Off Road/Competition” (off-road being defined as a private land with land owners permission and not public highway or byway). The Buyer also recognizes that Lithium batteries are classed as hazardous and should not be: stored, used, charged in place, facility any area that is not fire proof or safe to do so. That batteries should not be taken into the family home, office, workplace or school place. No other applications are intended or implied. The Buyer of product sold or provided by Electric Gen acknowledges and agrees that Seller disclaims any warranty and expressly disclaims any liability for personal injury or damages or any damages to vehicle, expensed occurred, personal property or third persons. Electric Gen will uphold the warranty of the manufacture of the product sold for a minimum of six months from date of purchase from manufacturer defect. In the event a manufacturer’s warranty exists, it is agreed and stated that Under no circumstances shall the seller or manufacture be liable for any labor charged or travel time incurred in diagnosis for defects, removal, or reinstallation of this product, or any contingent expenses.
